1 General Terms and Conditions

The following General Terms and Conditions apply to the contractual relationships concluded between the Seller and its customers (hereinafter referred to as the “Buyer”) within the framework of the online shop “www.cumbasilmite.de” operated by Uberto GmbH, represented by the Managing Director Mr. Elmar Heither, Berger Str. 2, 59698 Anröchte (hereinafter referred to as the “Seller”).

Contracts are concluded with both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional. According to Section 14 of the German Civil Code (BGB), an entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity. A partnership with legal capacity is a partnership that is endowed with the capacity to acquire rights and incur liabilities.

2 Conclusion of the contract

All products, articles and services available for purchase through the seller's online shop do not constitute binding offers by the seller in the legal sense, but are an invitation to the buyer to make an offer.

After the buyer has sent the order, he or she will immediately receive an email confirming receipt of the order and representing acceptance of the offer in the legal sense, whereby the contract is concluded.

3 Prices, VAT, Payment

All prices quoted are total prices including statutory VAT plus any shipping costs depending on the delivery method (see § 4) plus any shipping costs and packaging costs.

The seller offers the following payment methods: advance payment via bank transfer, PayPal, and Sofortüberweisung. The seller will issue the customer an invoice for the ordered goods, which will be sent via email.

4 Deliveries, shipping costs and transfer of risk

Delivery (delivery by a shipping company) will be made immediately after receipt of payment in case of advance payment by bank transfer or immediately after receipt of order in case of all other payment methods offered.

The seller's delivery and payment terms are detailed in the order form. Please refer to the respective item description for the delivery date.

On the last order page before submitting your offer (“order with payment”) you will receive a complete overview of the essential features of the goods, the total price of the goods, and all associated components such as shipping and packaging costs.

If the buyer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), the shipping risk is borne exclusively by the seller. If, however, the buyer is an entrepreneur, the risk passes to the buyer as soon as the seller has delivered the item to the freight forwarder or other person or institution designated to carry out the shipment.

5 Retention of title

The seller reserves ownership of the goods until the purchase price has been paid in full.

6 Liability for defects

The statutory liability for defects applies to our goods.

7 Further information obligations for distance contracts and electronic commerce

Technical steps for contract conclusion/order process. Select the products you wish to order by clicking the "Add to Cart" button. This will place your selection in the shopping cart. You can change this selection at any time up until your order is submitted by changing the quantity, deleting the selection by clicking the "Remove" button, or canceling the order process. Clicking the "Checkout" button will take you to the next order step. If you already have a customer account, please log in with a username and password; otherwise, please register as a new customer. Your data will be collected, processed, and used in compliance with data protection regulations. It will not be used for any other purpose or passed on to third parties. After entering the customer and billing information, registration must be completed by clicking the "Next" button. Now check the selected delivery and billing address. You can access the next step by clicking the "Proceed to Checkout" button. Now check the selected payment method and shipping method . Please read the General Terms and Conditions and the Cancellation Policy carefully. By clicking the "Order with payment" button, you submit your order to us. You hereby submit a legally binding offer. The contract text will be stored after conclusion of the contract and made accessible to the customer.

The contract text and your order details are saved by the seller. After completing your order, you will receive a clear order confirmation containing all the details of your order. You can also print the contract text using your browser's print function. Your order details will also be included separately in the email sent to you. Furthermore, the seller will send the contract terms to the buyer by email at any time upon request.

Possibility of correcting input errors

You have the option to correct your entries at any time before submitting your order. This can be done using the "back button" or the "back arrow" on your internet browser. You can make corrections either directly on the individual offer pages in the available input fields. You also have the option of updating the products or deleting individual products within the virtual shopping cart. All of these correction options are available up to and including the submission of the binding offer by clicking the "BUY" button.

Contract language

The contract language is exclusively German.

Codes of Conduct

The seller has not submitted to any relevant codes of conduct.

Order confirmation

After the customer has submitted the offer, he or she will receive a confirmation email.

Complaints and warranties

Complaints, especially warranty claims, must be addressed to the seller.

Essential characteristics of the goods

The essential features of the product can be found in the item description. This also applies to the validity period of any limited-time offers.

8 Data protection notice

a) The collection, storage, modification, transmission, blocking, deletion and use of your personal data is carried out in compliance with the applicable data protection regulations.

b) Your personal data will only be passed on to third parties involved in the contract execution, such as the credit institution responsible for payment matters and the logistics company responsible for delivery. However, if your personal data is passed on to third parties, the scope of the data transmitted will be limited to the minimum necessary.

c) By concluding the contract, you consent to the processing and use of your personal data (e.g., address) in accordance with the aforementioned information. However, you have the right to object to this use at any time without incurring any costs other than the transmission costs according to the basic rates.

d) According to the Federal Data Protection Act, you have the right to free information about your stored data, as well as, if applicable, the right to have this data corrected, blocked, or deleted. Please contact us with any relevant inquiries at the address provided in the provider's information. If the personal data stored about you by the provider is incorrect, it will be corrected immediately upon your notification.

e) Data protection is guaranteed by the Federal Data Protection Act. Use is therefore only permitted if the Federal Data Protection Act or a legal provision permits it, or if the data subject consents.

9 Final provision

The contractual relationship between the seller and the customer, as well as the respective terms and conditions, are governed by the law of the Federal Republic of Germany. Consumers with their habitual residence abroad may also rely on the law of the country in which they are domiciled, regardless of the specific choice of law.

Alternative dispute resolution according to Art. 14 para. 1 ODR -VO and § 36 VSBG:
